Fair Use Policy

1. Purpose and Scope

This Fair Use Policy (“Policy”) accompanies Qstomizer’s Terms of Service and applies to all subscription plans, including those labeled as "Unlimited." Our goal is to ensure a high-quality, stable, and high-performance experience for all our merchants.

2. Definition of "Unlimited"

While Qstomizer offers "unlimited" orders and customizations in several plans, these features are intended for regular and reasonable business use within the Shopify ecosystem. "Unlimited" does not mean infinite or unrestricted use that negatively impacts our infrastructure or other users' service quality.

3. Usage Restrictions & Monitoring

To maintain optimal performance, we monitor system-wide resource usage (including but not limited to API calls, media storage, and server processing). Usage may be considered "unfair" or "excessive" if it:

• Significantly exceeds the average usage patterns of merchants in a similar tier.

• Is used for automated, non-human processes (e.g., scraping, mass automated uploads, or bot-driven customizations).

• Jeopardizes the stability, security, or performance of Qstomizer's AWS infrastructure.

4. Corrective Actions

If your usage is flagged as excessive or in violation of this Policy, Qstomizer reserves the right to:

• Notify: We will contact you to discuss your needs and potentially offer a tailored enterprise solution.

• Throttle: Temporarily limit the processing speed or frequency of your customizations to protect system integrity.

• Upgrade: Require a migration to a higher-tier plan that better suits your volume.

5. AI Features Usage

Features powered by Artificial Intelligence (such as Background Removal or Text-to-Image) are subject to specific credit limits or stricter fair use monitoring due to their high marginal operational costs.
